Case 2 Basma (formerly Patricia), a recent convert to Islam, alleges that she was terminated from her job as a metal punch operator in a metal fabrication plant because of her religion (Islam). Shortly after her conversion, she notified her supervisor, Ken, that her new faith required her to dress according to hijab, "the correct standard of modesty." She also stated that this meant she could no longer wear pants, as required by the factory's dress code She further requested religious accommodation by being permitted to wear the jibaab, loose-fiting floor-length garment, while at work. Ken responded that this could not be done as OHSA and other safety regulations pr cluded anyone from working around the machinery in loose clothing. Ken then sa he could transfer her to another job. He told her that the only other jobs in the plant we interstate truck driver and office worker. Ken informed her that since she possessed clerical skills, she was not qualified for the office. He then asked her if she could a tractor trailer, to which she responded that she could not. When Basma showed up work the next day in a jibaab, Ken told her to go home and return in the ap attire. When she refused, she was terminated. a) Ken isnt involved in religious descrimination. As working in loose clothes in the factory near machinery is really fatal. So she can only work there in the attire which company says to wear. Basma can come to the factory in hijab and there she can change her clothes and could work in the attire which company allows. And at the time of going back home she can again go back in hijab. This is the simple way to work.
Ken was totally fair as he also tried to look for other options for Basma but unfortunately none of them were suiting her.
b) No it was not a reasonable religious accomodation for Basma because as per safety it was required to work in the attire company has approved. And also it was very fatal for Basma to work in hijab as many accident were also met with the machinery due to loose fitting clothes. She could come to the factory in Hijab but can work there in the company attire.
