Create a chart which lists the parties (aka stakeholders), their interests and their BATNAs (list these in a chart) Where does the dispute fall on the spiral of unmanaged conflict? Your recommended interventions must be supported by reference to course material and/or outside research. Remember, mediation is not always the best, or the only, process. Explanation / Answer
The public dispute that i have selected is the dispute between the tram drivers in Ireland and Luas operator Transdev.
The parties and their BATNAs (best alternate to a negotiated agreement) are:
(i) The tram drivers - The union of the drivers are on strike over a pay claim of upto 53%. The drivers have planned a strike for the following dates in April 2016 - 2nd, 3rd, 23rd and 24th. The strike will cover Easter Sunday, Easter Monday, and St. Patrick's day.
Interests: The drivers are the employees of Transdev. Their interests lies in the proposed increase in pay that they are demanding.
BATNA for tram drivers: Currently Transdev has refused to enter into any talks with the union. The most advantageous alternative course of action for the drivers would be to involve the department of transport in the issue and settle for a mutually agreeable hike.
(ii) Transdev - The company operates Luas - the light rail system in Dublin.
Interests: Transdev's interest lies in the successful and uninterrupted running of its operations at Dublin, without having to bow down before the pressure being put by its drivers regarding pay claim of upto 53%.
BATNA: The most advantageous alternative course of action for would be that the WRC - workplace relations commission - is able to reason with the workers and make them understand Transdev's position.
My recommended intervention in this case will be conciliation through WRC. WRC can meet both the union and the company separately and try and resolve their differences. I have recommended this method as even the transport minister Paschal Donohoe is not interested in intervening in the matter. This intervention has been selected over other methods like judicial dispute resolution as the transport minister has clearly stated his intentions of not getting involved in the issue and Transdev is planning to press buses into service to offset the effects of the strike. Thus conciliation through WRC seems to be the most plausible.
