Question

A psychologist keeps notes of her patients on her desktop computer, and the files are
encrypted. While reading a professional blog online, malware gets into her computer and
downloads the patient records. The malware then contacts the patients themselves and
demands ransom to delete the downloaded files, or else these will be posted online at dozens of
websites. The psychologist learns of this from her patients, who claim professional negligence.
The psychologist was previously unaware of the data breach. The psychologist has an errors
and omissions insurance policy, and a cyber policy. Discuss how each insurance policy should
respond to this situation.

Explanation / Answer

Discuss how each insurance policy should respond to this situation.

The cyber insurance or the cyber policy should respond because they are responsible in covering the data breach that might occur for the personal information of the customers, in this case patient’s personal information, by a hacker or firmware. The ommissions insurance includes the work of a software product that is responsible in bringing down the work of a business, data destruction, data breach etc. Further, there was an added responsibility called internet liability in ommision insurance. They carry out investigation of what had occurred and how the breach occurred along with finding out ways to prevent the same breach again. Also, they analyse the business losses plus they also take care of the lawsuits and extortions filed against the breach.
