Question

Texas passed an abortion law that requires all abortion clinics in the state to meet the same building, equipment, and staffing standards that surgical centers in hospitals must meet. Texas’s stated reason for making this a requirement is to protect the life and well-being of the mother. The necessity of the requirement for this purpose is controversial. Texas’s unstated reason for the requirement is to create another obstacle to a women’s having an abortion. If the requirement is allowed, it will result in the closing of 8 of the 18 facilities providing abortions in Texas. (Texas actually had 41 abortion clinics at the time the law was passed. Presumably other parts of Texas’s abortion laws resulted in the drop from 41 to 18.) The abortion clinics that must close are those that do not have enough money to upgrade to the standard set by the law. If the reduction in abortion clinics happens, 900,000 reproductive-age women will live more than 150 miles from the nearest open facility. Poor women who live far from an abortion clinic will have trouble getting the money they need to travel to the clinic and stay overnight if that is necessary. If they are unable to get the money, they will have to forgo an abortion. Others will be able to collect the needed money but it will take time. So the effect of the law on them will be delaying their having an abortion. According to some, it is immoral for Texas to prevent women from having an early abortion.

a. What is the strongest defense that one could give for this view? Note: to answer this question, you do not have to agree with them and you do not have to accept their defense.

Explanation / Answer

I don’t agree with the statement that; it is immoral for Texas to prevent women from having an early abortion as the law just requires all abortion clinics in the state to meet the same building, equipment, and staffing standards that surgical centers in hospitals must meet. Hence it is an effort to protect the life of the mother; which is at risk in case if the inadequate facility, which is especially true in the case of the state of Texas which has according to the news report, the highest maternal mortality rate in the developed world, (The Gaurdian,2016). Hence this is an effort to save lives of mother’s rather than delay abortion
