A) The word "Unauthorized" says it all. The attempt to try to access a computer without the users consent is illegal and Unethical.
But in some scenarios it is Ethical. For example some police personnel is trying to get into a possible hacker or a criminals PC to get hold of evidences.
So yes the term exists,
B) It is the User of the card who is responsible if he/she uses the card in an untrusted website,
If the website is trusted and even though the card details gets leaked, it it the site which will be responsible.
