The Age Discrimination in Employment Act of 1967 is a benefit or compliance issue that all organizations must be aware of. In fact, according to the U.S. Equal Employment Opportunity Commission (EEOC), the act states it is “unlawful for an employer to refuse to hire or to discharge any individual or otherwise discriminate against any individual with respect to his compensation, terms or privileges of employment, because of such individual’s age” (EEOC). In addition, the act states, “age discrimination is unlawful in any phase of employment including job postings, job descriptions, interviews, hiring, salaries, job assignments, merit increases, performance management and evaluations, training, disciplinary actions, promotions, demotions, benefits, employment termination and layoffs (Heathfield, 2016). Therefore during interviews, companies must steer away for questions that inquire about age or when an applicant graduated. This can be perceived as age discrimination if the company “used this information to eliminate a candidate” (Heathfield, 2016).

The discrimination on the basis of age can land companies in trouble as it is unlawful to do any bias on the basis of age. Actions such as asking the age of a candidate during an interview or during an appraisal of employees are regarded as an unlawful activity.

Equal Employment Opportunity Commission (EEOC) clearly states that discriminating an employee in promotions, employment privileges, benefits, etc. is an act of discrimination and an employee can seek legal help in such matters and company will be liable for damages if the case is proved in the court. Many companies do discrimination on the basis of age, like not selecting a candidate because he/she is too old or too young, and not based on the qualifications of the candidate or prior experience. Such cases of discrimination can land companies in unlawful practices during recruitment.

Similarly, no employee can be passed over for promotion or employment benefits offered by the employer on the basis of age. Benefits such as health insurance, pension fund, etc. cannot be decided on the basis of age but as per job roles and requirements.

Candidates and employees must be aware of their rights and if they feel they are discriminated, they can reach out to the local agencies for help.
