The benefit and compliance issue that is potentially risky if organizations ignore it is Family and Medical Leave Act of 1993 (FMLA). “FMLA requires employers to continue providing health care coverage to employees who are on FMLA leave (up to 12 weeks per year for specified family emergencies) on the same basis that it was provided before the leave period (Module 3).” FMLA helps the employee during times of self or family sickness that are unseen, planned or unplanned when the condition is a qualified one recognized by FMLA. In other words, an employee cannot file FMLA to care for a family pet dog that is 25 years (over 80 years in dog years) old and having seizures but FMLA can be used to care for a parent or child with a serious health condition (Mansourian, 2015). It is the employee’s responsibility to notify the supervisor to request FMLA. If employers deny employees FMLA without legal substantiating reasons, the organization could be at fault and sued for non-compliance under the following three laws: Public Law 103-3, 5 U.S.C. 6381-6387, and 5 CFR part 630, subpart L. FMLA is protected by the three laws mentioned which also provide the operating basis for approving FMLA. If an employer decides to ignore the laws, serious consequences will follow. Consequences can also be applied to employees who submit false certifications for usage of FMLA, and in some case this false accusation can be seen as fraud, waste, and abuse which could lead to termination (Family and Medical Leave for Federal Employees). In any case, when an employee request FMLA, due diligence should be implemented and have the employee complete the required organizational documentation for usage and process the request expeditiously. The employee’s benefits in an organization are the common factors that determine organizational ethical procedures which need to be uplifted and taken care of by the organization to its employees. Medical treatments benefits like good healthcare facilities and various wellness programs are very necessary to be given by the organization to its employees. As employees are the workforce of the organization for their betterment purpose it is necessary to maintain good policies to enlist health benefits to the organizations. One of the leave acts of 1993 is FMLA (Family and Medical Leave Act). The act describes that an employee with any sickness can take the advantage of this act to take any leave at any time. The organizations are also required to adopt this act so that employee can take leave whenever they need. The rule of FMLA states that if any organization denies allowing the leave to any employee strict action will be taken to them.
To grant the leave it must meet FMLA condition only in blood relation cases or the employee is found sick then only the leaves will be granted otherwise for it not be granted if the employee of a leave for anyone which is not belonging to his/her blood relatives. The organization will proctor every document that is submitted for any the leave; if the organization found that there is a discrepancy in the medical document then the leave will not be granted to the employees and strict termination is guaranteed in this case which may lead to losing the job in the organization. So before placing an application of leave, it is necessary to make hundred percent sure that the medical reports are genuine and the intentions of taking leaves are right.
