If I were the manager of the entire office I would have opted for the first option to address the problem which states that the lawsuit should be settled down and Bernadine Pearce should be allowed to retire because of her behavioural issues although she has given 40 years of her life to the organization but that can not be the reason to tolerate such a behaviour which makes other employees feel humiliated and lower their productivity level as well as hamper the organization image which definitely gets affected when empoyees move out of the organization and discuss the work environment outside the organization.

since such type of leaders create a negative work environment which dips the organizational productivity in long run. This type of behaviour demotivates the employees and at times gives a boost to attrition rate in the organization so after analysing the consequences of such behaviour Pearce should be allowed to retire.
