One type essentially increases the penalty for committing others crimes if the reason the defendant committed the crime was based upon hatred of a specific group (e.g. race, religion, nationality, gender, sexual orientation etc.). In other words, if a person commits a crime based upon hatred he ill suffer a higher punishment that if he commits the same crime for some other reason Is this fair and just? Yes, it is fair. Actually, this law is getting segregated with the one which is against the hatred amongst one another.

Because it is related and since the hatred law also states that it is a crime to provoke hatred so if one is provoked because of hatred towards another then it is absolutely fair to have them prosecuted for both the crimes hence the extra punishment when proved.
