Question

Read the situation and provide the tort that is illustrated. Is the tort an intentional tort, negligence, or strict liability? Tell me about the requirements and how/if those requirements are met in the examples provided and what if any defenses exist for that tort 1. Mr. Hooper believes that Billy, a local 18-year-old troublemaker, has been shoplifting in Mr. Hooper's small drug store. Mr. Hooper follows Billy toward the front of the store and then orders Bruno the security guard to stop Billy from leaving the store until Mr Hooper can find out if Billy has shoplifted any merchandise. Bruno doesn't use force, but he is 6'5" and weighs 270, so he really doesn't have to. While Billy is being detained at the store, he is discovered to be in possession of 3 brand new pregnancy tests missing from the store's shelves.

Explanation / Answer

This is an example of an intentional tort where Billy has been clearly involved in shoplifting merchandise from the store and it is considered to be an intentional violation. This is categorized as fraud or theft and falls under the broader category of Intentional Tort.
