The new principal, Bob, who has held his position for only two years, recommended dismissal for incompetency based on 2 informal assessment of Gloria’s performance.

Explanation / Answer

1) As per my opinioin the chances of Gloria's dismissal on incompetency grounds are negligible.Reason being she is associated with the school for last 15 years and her formal evaluation was good under previous administration.Two negative informal assessments cannot create a solid ground for her dismissal.Further the new principal Bob has held this position for 2 years only which is a small period to judge a persons capability on based on informal feedback which can be biased too.

2) Process for successfully removing a teacher for incompetence are - (a) The ratings in formal annual appraisal should be very poor (b) Misbehaviour with the students may also result in termination (c) Immediate termination can be done on grounds of Integrity.

3) Based on the information provided treatment with Gloria is not fair for 2 resons : (a) She has served the school for 15 years and showed her loyalty with a good rating in formal evaluation but in turn what she is getting is not fair.

(b) If her 2 informal assessments were not good then that should be communicated to her during the formal assessment so that she gets a chance to improve in that area where she is lacking.

4) Court would ideally look for documentary evidence where Gloria should have been given a heads up of her poor performance and any performance improvement plan that has been shared with her where her performance is tracked over the period. If during that period also there is sufficient evidence to prove that she is incapable to continue with this profession then court may give decision in principal Bob's favour.

5) Administartive implications are as below:

a) Others teachers might feel insecure regarding their job.

b) Students may have to temporariy suffer till new teacher with a relevant experience joins.

c) Loss to the reputation of school as this can raise doubts on quality of teachers.

d) Teachers will never share a frank opinion with principal as the relations would be very very formal.
