Minors are generally not "competent" to enter into binding contracts. Since young people are exposed to a much more complex world than previous generations, isn't it reasonable that the minimum age for competency should be adjusted downward? Why/why not?

Could you write a response with a statistics or research findings on why the age SHOULD stay the same

Explanation / Answer

I would agree with “no”.

It is better to have a competent age for everything. This is because major people are able to think & reason in a wider perspective. Whereas minor age people don’t have such broader thinking. Adults or people who has attained majority have better cognitive skills that has better control & coordination over their thoughts & behavior. The thoughts, ideas & concepts developed at this period of life greatly influence one’s life playing a major role in the formation of their character & personality. Hence all these aspects play an important role in making important decisions regarding entering into a contract or not. What can be the benefits & problems that may arise as a result of entering into such contracts.

Hence for deciding all this, there requires some maturity which don’t think minors may not be aware what is good or bad or what can be the outcomes of such contracts. They can decide all these only with the support of a guardian.

For example if we take the case of Kim Young Vs Philip Weaver

Young who have been living with her parents decided to move out & stay separately in a apartment. Weaver who was the owner of the apartment filed a suit against young as her dog damaged the floor & bathroom door of the apartment. Young agued in the court that she was a minor & not bound by such charges. Under Alabama law, a person who is under the age of 19 is subject to disabilities of nonage. Among the disabilities of nonage is incapacity to enter into a contract. Hence being a minor she is not liable for any damages as per court’s judgment
