Question

You are a paralegal working for the firm of Channing & Tatum. Your supervising attorney, Mr. Channing, has asked you to meet with his new client, Lola, to get basic background information such as her date of birth, names of her children, work history, address, financial information, etc. You meet with Lola and she proceeds to tell that she has retained Mr. Channing to represent her in her divorce. Lola then explains how her husband cheated with her best friend Trixie and used her credit cards without her permission to buy Trixie lavish gifts. After telling you all this, she then asks you for your opinion on her case including how much alimony she should ask for, if she will be granted full custody of their children, how much child support will she receive, and if she should have her husband arrested for stealing her credit cards. You have been working as a paralegal for many years and are very experienced in these types of matters and have handled many divorce cases with similar facts so you know the answers to all of her questions. What should you tell her? After meeting with Lola, you go grab lunch with another paralegal, Donna, who works in your office but for Mr. Tatum. Donna starts talking about a divorce case she's currently working on that involves a husband who was cheating with his wife's best friend. You then start discussing Lola's case and how her husband did the same exact thing. Are you permitted to discuss Lola's case with the other paralegal? Why or why not? What if you realize that Trixie is one of your Facebook friends, and although you don't really know her and have never met her in real life and your only contact with her has been liking some of the photos she has posted, do you have to tell Mr. Channing? What if some of the pictures Trixie posted were of the gifts that Lola's husband bought her? What should you do? What ethical rules are involved in this scenario?
