Jack gave his girlfriend, Ann, a check, but he left the amount incomplete. The check was given as partial payment for a $2,500 loan that Ann made to Jack three months prior. The amount was left blank because Jack was in a hurry. He signed a blank check and told Ann to fill out the check for $500. Ann needed to make her $950 car payment. Ann wrote the check for $950 and cashed it at Jack's bank. Jack was upset when he found out about it. He broke up with Ann and demanded that she immediately pay him the $450 difference. Ann refused claiming Jack owed her more than that. Jack sued Ann for the $450.

Will Jack be successful? Discuss why or why not.

Jack will not be successful as he has no proof that he asked Ann to encash only 500$ and not 950$. Even If he can prove that the handwriting on the check where the amount is written is of Ann's and not his, still the check has his signature on it which means that he has given her consent.
Also, the fact that Jack owed Ann 2500$, will go against Jack as actually Jack still owes 1550$ to Ann.
There prior relationship may have an effect as the argument can be posed that Jack made a relationship for the money and after breaking up, he is trying to get more money through a law suit
Hence Jack will not be successful.
