Write a law paper on the topic of Americans with disabilities. This paper is to be written from the viewpoint of an HR professional. In other words, you are the HR manager dealing with an issue relating to your chosen law. The law is selected from Title VII.

Your paper should include the following:

Definition and explanation of the law

A hypothetical case of misconduct or policy violations in the workplace regarding this law

Determine who is impacted (just the perpetrator, other employees, the organization)

Explain the risks to the company

Recommend the proper course of action/remedy for the employee

Recommend any actions to be taken by the organization to minimize the risk, stop future violations and/or avoid litigation.

The thrust of the research is for each student to become familiar with one particular law and how this law impacts the workplace.

The American with Disabilities Act law has made a positive effect on the lives of individuals with disabilities.Americans with disabilities are treatedequally, how has the law affected the change. Prior to this law individual with disabilities were not treated equally. For instance, over the past twenty-five years, the ADA has stepped up for those with all forms of disabilities. For example, employ opportunities and compensation have increased for these individuals. In addition, building codes have been reformed. Transportation has been modifiedin order to accommodate those with disabilities.

Gupta, V. (2016) The 26th anniversary of Americans with Disabilities act happened in July of 2016, in 1990 President G. Bush signed the law that made equal rights for those with disabilities. With the ADA Law in affect, those with disabilities no longer made $0.02-$1.07 per hour. The positive effect of this law can be seen in how individuals with disabilities are paid. Prior to the law,these individualswere paid less than their co-workers without disabilities. With the implantation of the ADA law, individual now receive equal payEEOC. (2016). EEOC stands for the rights of those with disabilities. “The EEOC “Equal Employment Opportunity Commission” enforces the federal law prohibiting workplace discrimination against those with disabilities.” For example, Local companies now employ individuals who are disabled by providing them with jobs/task such as environmental and nutritional services.

With the implantation of the ADA law, building codes have been changed in order to accommodate individuals with disabilities. Automatic doors, ramps, elevators, and handicap restrooms are required in public buildings.In addition, handrails are necessary for restrooms and stairs rails. Furthermore, parking lots are required to have handicap spaces.

In order to serve individuals with disabilities, modifications had to be implemented in transportation both public and personal. For example, public transport needs to be wheelchair accessible. Personal vehicles can be converted for individuals with disabilities. For instances, vehicles can be altered so that accelerating and stopping are controlled by the hands.

In conclusion, the American with Disabilities Act law has made a positive effect. With the implantation of the ADA law, individuals now receive equal pay and building codes have been changed in order to accommodate those with disabilities. Furthermore, individuals with disabilities have implemented a major modification to transportation whether it's public or personal. The law in itself has improved the lives of those with disabilities.

                                    New Addition

In additions to the protection given by the ADA, in 2008 the Americans with Disabilities Act Amendment Act was signed into law. With this new act, even more guidelines and accommodations were granted and enforced to better assist Americans with disabilities. These expansions include laws against discrimination and harassment as well as better accommodations. The amendments did just offer protection for those with disabilities, it also offered protection to businesses. An example of this is the Undue Hardship which allows businesses to not hire someone with a disability if it would be too difficult or expensive to provide for that person. It is also up to the employer which accommodation it can use for the person.

            With the ADAAA the definition of a person with a disability has been completely changed as well. Just because you have a disability it does not mean you will be entitled to employment. A person must still qualify for the position they are applying for. There are various ways to show that a person has a disability. A person may be disabled if he or she has a physical or mental condition that substantially limits a major life activity (such as walking, talking, seeing, hearing, or learning).A person may be disabled if he or she has a history of a disability (such as cancer that is in remission).A person may be disabled if he is believed to have a physical or mental impairment that is not transitory (lasting or expected to last six months or less) and minor (even if he does not have such an impairment). To ensure all parties are protected the employer may request to have a medical exam or ask medical questions in the event that an accommodation is needed. Another reason to do so would be to ensure that the employee is able to perform the job safely. The law does, however, require these medical records be kept confidential and in a separate file
