   •   Provide a brief summary of The Coca-Cola Company’s efforts to protect its soft drink formula as a trade secret.

   •   Describe one (1) challenge the company has faced in preserving its trade secret.

   •   Describe two (2) reasons why The Coca-Cola Company would choose to protect its soft drink formula as a trade secret, as opposed to using another form of intellectual property protection (for example, a patent).
Part B
   •   Through Internet research, find and describe three (3) examples of physical or mental problems covered by the American with Disabilities Act (ADA), and three (3) examples of physical or mental problems not covered by the ADA.

   •   Present an argument supporting the position that the ADA has been appropriately interpreted and applied by the courts (in terms of the types of disabilities covered), or that it has not (for example, that it has been overly interpreted and applied to too many types of physical and mental maladies). Provide two (2) supporting facts to justify your position.

Explanation / Answer

a. Trade secrets refer to the information that provides economic value to a company or entity by maintaining the secrecy. The Coca-Cola Company is making huge efforts to protect its soft drink formula as a trade secret. Despite of being a multinational firm, very few people knows the formula to prepare the drink. Initially formula to prepare it was not present in written to maintain the secrecy. Later, the formula was written and kept under a lock in a bank vault.

b. The company has faced certain problems in maintaining the trade secret. Trade secret is very difficult to enforce as its level of protection is weaker than patents. Trade secret is also very expensive to use.

c. Trade secret protection is not limited up to certain period. It can be continued for an indefinite period. Hence the company does not need to worry about its expiry period like patent. Trade secret is also useful for the company as the formula to prepare the soft-drink is not patentable.
