Maurice is an accountant who works for the firm of Addum, Upp, & Paymee. Maurice was approached by Shirley Eugest, who represents one of Addum’s competitors, BeanCounters, Inc. Maurice was offered a substantial raise to leave his company and work for BeanCounters. When Maurice's boss heard this he called him in and said, “If you stay with us, I promise that next year you will receive a promotion with a 50% raise, and a 5-year contract.” Maurice turned down the offer from BeanCounters and stayed with Addum. Nine months later Maurice was dismissed due to corporate downsizing. Can Maurice legally enforce his boss’s promise? What theory or theories would Maurice use? Discuss fully.

Explanation / Answer

In general a verbal contrat is legally enforcable but there is a big problem with it which is : How do you prove what was agreed upon?

How can Maurice prove that his boss promises him the raise and a 5 year contract?

If Maurice recoreded the conversation then he has a great opportunity to prove this in court.

If he didnt then the former boss can speak as a witness and mention he did offer the 5 year contract .

There is another thing Maurice needs to take in consideration, the fact that depending on the State oral and written contracts have different time to sue for breach , and usually the oral contract is shorter.

If Maurica didnt recorded the convesation and former boss is not willing to testify on his favor then most likely Maurice will not be able to enforce his boss`s promise
