Diane, a long-term employee, has approached you, the Human Resource Offier, because she feels like she is the victim of harassment. She tells you that she has witnessed a male homosexual supervisor flirting with a fellow male employee. He has even asked him out! Although the fellow employee has declined the supervisor, he continues to ask him out and flirt with him. Diane does not know whether the fellow employee is also a homosexual but either way, the interactions are making her uncomfortable. Do you think this could be harassment? Why or why not?

No this could not be harassment. Harassment is an intentional behavior which leads to threatening of another employee or results in disturbing that employee.
Here the male supervisor is homosexual and is flirting with fellow male employee not with an intention to disturb or threaten Diane. There is no element of bothering or troubling or tormenting Diane. She is getting disturbed by what she has witnessed i.e the flirting of the male employees. Howvere, the male employees are not flirting to torment or disturb her.
So, this will not be considered as harassment.
