Question

Lynn Hines is employed by Irwin Industries. She recently became a Seven Day Adventist and has informed her emplyer that she can no longer work on Saturday. Irwin Industries makes seat custions for air planes and is a relatively small operation. While Saturday is not a regular work day, frequently emplyees are required to work on Saturday and they are informed of this condition of employment during the hiring process. Lynn is told by her supervisor that if the plant is operating on a Saturday, she will have to be there unless she is sick. He explained to Lynn that he had no one to do her job and her absence would slow down production. The following Saturday, Lynn failed to report to work and she was fired. She filed a claim for religious discrimination under Title VII. Discuss this case from Irwin Industries' perspective.

Explanation / Answer

Irwin industries maintaining service rules for seven days per week with a exception of sickness, This service condition were included in the service rules of the co to prevent slow down. It is evident that Lynn failed to report in work in saturday nor she submitted proof of sickness. So lynn canot able to file a claim or RELIGIOUS discrimination and face the fire.

from the Irwin industries perspective, the postion is their favour, howver the Employer shall provide an other opportunity before punishing so severe action.

Chapter VII is relation to religious claim, not dealing with the general clauses of the service rules. The rules are in built to prevent the slowdown to build up their product to the customer within the contracted period failing which the employer ought to compensate the employer.

Therefore, it is seen that lynn is not correct and she must adhere the attendance on saturday in case of need, howver she is entiltled to one day leave per week. Further, her supervisor made it very clear to her that, there is no employee on that day in place of her , failing the production process will be slowed.

so lynn can not win against her prayer / petition.
