Question
On January 3, 2016, Newman, a dedicated, long term postal worker, delivered 30 letters in an 8 hour period. Todd Gak, Newman's supervisor, was so impressed that on January 4, 2016, he made the following statement: "Newman, that's awesome! I have the authority to grant bonuses to my employees for their superior productivity. You will get an extra $50 in your next paycheck. And, if you ever deliver more than 30 letters in an 8 hour period within the next two years, starting today, you will receive $100 more." Excitedly, Newman responded, "I'll take you up on that." Expecting to see an extra $50 in his paycheck, Newman purchased a non- returnable cabana swimsuit from Rudy's Antique Boutique for $50 on January 6, 2016. On February 17, 2016, Newman delivered 31 letters in 8 hours. It is now April 18, 2016, and Newman has not received either promised bonus. On March 7, 2016, both discussed the details, and Sue Ellen said she would pay Frank $200,000. Frank agreed to the price; however, a few minutes later Sue Ellen noticed that some of the windows looked in need of repair. She said that she would give Frank the $200,000 but wanted him to reduce that amount by the cost to repair the windows. Frank agreed to have Sue Ellen get two estimates for the window repairs within 2 days of their signing a sales document. On March 8, 2016, Frank typed a document describing the property, its location, a mortgage rate of 4%, & a move-in date of May 1, 2016. The selling price was left blank to allow Sue Ellen to get the two estimates. Both Frank & Sue Ellen signed & dated the document March 8, 2016. On March 9, 2016, Sue Ellen gave Frank the two bids from window contractors, the lower of which was $3,000. Frank refused to put the price of $197,000 into the document & refuses to sell his house to Sue Ellen. Discuss in detail Sue Ellen's rights to enforce the document by finding & discussing all legal issues. On January 6, 2016, Barry Profit signed a three year lease to rent an apartment from Cosmo Kramer. Both parties signed and dated the lease on January 6, 2016. The lease began on February 1, 2016, and Profit moved in on that date. On March 1, 2016, Profit phoned Kramer and told him that he could hear the subway as it passed his apartment. Kramer responded that if Profit agreed to pay an additional $100 per month extra for the remaining 35 months of the lease, he would replace all the windows with soundproof ones. Both agreed. On March 10, 2016, Profit met with Kramer to see when the windows would be replaced. Kramer responded that he was not going to replace them. As of April 15, 2016, the windows have not been replaced, and Profit has not paid the additional $100 per month. Profit seeks your advice. Advise him as to the enforceability of his conversation with Kramer by finding & discussing all legal issues.Explanation / Answer
1.
In the present case the supervisor who has the right to give employees bonuses on the basis of performance, exercised his right by granting a bonus to Newman on the basis of his performance. The supervisor also promised to pay $100 in case Newman was able to deliver more than 30 letter in 8 hour. The supervisor was fully justified in granting bonus to Newman as it valid to pay bonuses to employees based on their performance.
Thus, in the present case, Newman has a right to ask the company to pay for $50 as well $100 as part of performance based incentive.
