Explanation / Answer
Answer: Facts of the case: The plaintiff was a tailor. The defendant who was an undergraduate from Cambridge university had ordered eleven waistcoats. When plaintiff sued for payment the defendant claimed lack of capacity and due to this not able to make the payments. The argument of the Plaintiff was that the waistcoats were in the order of necessaries.
The judgement was that the court said it is true that the waistcoats are in the order of being categorised as a necessity but it is the plaintiff who has to prove that they are a necessity. This is the major reason that says the plaintiff is unable to enforce the contract.
