Question

Eduardo has recently moved to Pittsburgh and wishes to enhance his social life. While visiting the website of Made For You, Eduardo reads a pop-up window that states, “We are making a special introductory offer to new subscribers of $19.95 a month. To subscribe, enter your e-mail address in the window below and click ‘SUBSCRIBE.’ By subscribing, you agree to the terms of the subscriber’s agreement. To read this agreement, click ‘AGREEMENT.’” Eduardo enters his e-mail address and clicks ‘SUBSCRIBE,’ but does not click ‘AGREEMENT’ and does not read the terms.

A. Has Eduardo entered into an enforceable contract? Why?

Explanation / Answer

in general state laws often require written contracts for certain transactions such as real estate sales or contracts that will last more than one year. we need to check your state’s laws to figure out which contracts must legally be in writing. of course, because oral contracts can be difficult or impossible to prove, it is wise to write out most agreements, even if not legally required.

yes, it is an enforceable contract only. because he accepts that he perform the obligation irrespective of any conditions. and he made it by clicking on agreement. before click on it he must read all the terms and conditions to the contract, but he does not read it. it does not make any difference wether he read them or not if he click on agreement to the contract. once later if he feels uncomfortable or any problem, he can not come back. he will be forced to do it.
