Tara is a female, naturalized U.S. citizen of Irish decent. She is employed by British Industries, Inc. in New York City. Tara has been employed by British Industries for eight years and is expecting a promotion from researcher to client service manager. Though Tara has been in the U.S. for more than ten years, she still speaks with a distinct Irish accent. Tara’s boss has just advised her that she will not be promoted to client service manager because her Irish accent is not appreciated by the clients of British Industries. Does Tara have a claim under the Civil Rights Act? What is the process for filing that claim? Where is the claim filed, and how is the claim processed?

Explanation / Answer

Tara has the right to file a claim under Civil Rights Act. A person cannot be discriminated at the workplace and cannot be denied any position based on his/her sex, race, color, religion and nationality. In Tara’s case, her Irish accent was the reason she was denied promotion which was against the Civil rights Act.

Process of filing the claim:

The Equal Employment Opportunity Commission (EEOC) is charged with enforcing Title VII. Tara must begin to file a complaint with EEOC. In Tara’s case, it was an advice from her boss but no action has been taken on her promotion yet. Hence, she might need to have a proof for her claim. Claim must be filed with the EEOC within 180 days of the discriminatory act.

The EEOC would notify the employer that Tara has filed a discrimination charge and would begin an investigation into her complaint.
