Question
1.) A corporation owns and operates a company that procues and distributes materials used in explosives. As a result of a 5 gallon drum of ignitable material left open adjacent to the company's boiler room, two employees were recently killed in an explosion. To make matters worse, EPA inspectors recently discovered that the company's predecessor disposed highly toxic materials over five acres of ground outside the company's plant in the 1920's, potentially affecting a nearby towns drinking water supply. What laws or legal actions initiated by citizens may apply to these situations? Describe how and why.
Explanation / Answer
As we know EPA in US works to make sure that all the citizens of States have cleaner air, water and land, hence it is important for the citizens to know what power lies in their hand when it comes to take legal action against unlawful waste dumps especially which are toxic and hazardous in nature. Some of the legal actions that could help to cumber the situation affected/contaminated areas of drinking water supply are pointed as follows:
Most importantly citizens should know the basic difference between Environmental Violation and Environment Emergencies, where the former means an activity or an existing condition which do not comply with an environmental law or regulation whereas environmental emergency is a sudden threat to the public health or the well-being of the environment, arising from the release of toxic and hazardous spill or dump into the air, land, or water. Keeping this in mind a citizen can initiate a legal precedure and follow up the laws enforced and guaranteed to them in the country.
