Q1. Some of the organizations in international business community works for protecting the rights which is included in the intelluctal property laws. Some of those organizations includes world trade organizations, the federal patent statute of U.S etc. Although these organizations could not cover all the area which is included in the law it is having a major control over the pirates in international business. In some countries like India, China etc the rules and regulations against antipiracy are very not strict. Since it is a developing economy most of the international companies will prefer to flourish business in these countries. Hence in such countires the problem of piracy really exists. It is also highlighted in the case that Chinese government officials are also involved in producing pirated products. In such countries implementing intelluctual property laws will be very difficult.
The international companies will certainly fear to do business in such countries. In some countries the companies which violates trade mark laws will have to face very serious leagal issues. Violating these laws in Italy and european countries can harm the reputation of the company .
Q2. The digital communication systems like internet has increased the rate of piracy. Through the websites of online selling companies like ebay pirates could sell more illegal products as the chances of identifying pirated products are very less. Hence digital communication has become a real threat to intelluctual property laws. Through internet the establishing international business is very easier. This pirates misutilize this facility as it incurr only low cost for establishing their business too.
Even though the intelluctual property law restricts the priacy of Films, musics etc the internet provides the opportuinty to counterfiet those products.
Q3. Tiffany is an international organization which deals with luxury products, jewelry etc. Recently the company identified that its products are getting pirated and selled online through a reputed company ebay. Tiffany filed cased aginst it. They argue that the online company should be responsible for such counterfiet activities. They also says that ebay supports such activities as they get more profit for selling such counterfiet products. Ebay defends the argument of tiffany by saying that it is very difficult to find the pirates while performing online business. They argue that they cannot take the responsibility.
It has been identified that 73% of the Tiffany jewelry sold through ebay is counterfiet. Tiffany argues that ebay is cheating tiffany as well as the customers by promoting selling counterfiet products. Finally the lawsuit asked ebay to be stopped from the listing of tiffany and to pay a penalty of $1million if they further sell any counterfiet products.
Although ebay claims that they are not experts in the fields like jewelry, car, clothing etc but we just promote selling these products through online. They specifes that only experts in this field could identify the counterfiet products
