U LLOJIED20 2p0Urses/BL0 4182 BAS 267 19Z1 1339 Business Law Case 4 Mackowick v. Westinghouse Electric Willian Mackowick, who had worked as an electrician for thirty years, was installing high-voltage capacitors in a switchgear room in a hospital when he noticed electrician had removed the cover from an existing capacitor manufactured by Westinghouse Electric corp Westinghouse had placed a warning label inside the cover of he metal box containing the capacitor on which users were instructed to ground the electricity before handling. Nothing was said on the label about the propensity of electricity to "arc." (Arcing occurs when electricity grounds itself by "jumping" to a nearby object or instrument.) Mackowick walked over to warn the other electrician of the danger associated with the exposed capacitor, and while talking, pointed his screwdriver toward the capacitor box. The electricity flowing through the fuses arced to the crewdriver and sent a high-voltage electric current through Mackowick's body. As a result, he sustained severe burns and was unable to return to work for that a fellow three months. Should Westinghouse be held liable because it Eailed to warn users of arcing-a principle of electricity? Discuss.

Explanation / Answer

Generally, capacitor should be also attach with ground for safty reason if human touch the capacitor without grounded then electricity can flow from human body and it can to harm the human. In the case of william mackowick, he was very experienced but he didn't know about capacitor working or about grounding of capacitor. It is not a reason that William mackowick get harm because of absence of warning cover. He was thirty year experience holder.yes slightly absence of warning cover is also responsible because William mackowick may be forget this instruction. conclusion is that Westinghouse is not responsible for this harm. It already instructed to the users.
