Elements of a crime:
Actus reus: It is a criminal act that happened because of a voluntary bodily movement. Negligence to the criminal activity is also another form os Actus reus.
Example: A person under the influence of alcohol will kill someone on the road. The blood test will show the presence of alcohol in his blood and this is enough to prove him guilty.
Mens rea: It mainly describes the mental state a person when he is committing a crime for it to be intentional. Only an act cannot become a crime unless the person has the required state of mind to commit that crime.
Example: A psychopath will plan the crime he is going to commit and execute the plan accordingly. His mind will play a big role in the crime.
White collar crime is:
Nonviolent: The crime is only related to the business and financial aspects of a business. So the crime is usually related to the misuse of the information available or selling the information to someone. So there is no physical aggression involved.
Financially motivated: People do this to make money in a quick way. This will be against the work ethics but people still do it just for the money they can make out of the crime. In some situations, it can give them the power and authority as well.
Perpetrated by someone with authority: The person who has the authority will do this kind of crime in gain more power or with an intention of taking over the business. The people at the top management are usually involved in these types of crime.
Usually by a business or corporation: The entire organization will be involved in this in order to save tax or share confidential information with another company to make money or cheat the government to save money.
