1. A Georgia state law requires the use of contoured rear fender mudguards on trucks and trailers operating within Georgia state lines. The statute further makes it illegal for trucks and trailers to use straight mudguards. In 35 other states, straight mudguards are legal. In Florida, straight mudguards are explicitly required by law. There is some evidence suggesting that contoured mudguards might be a little safer than straight. Discuss whether this Georgia state statute violates any constitutional provisions.
Explanation / Answer
Having a statute of usage of contoured mudguards whicha re technically feasible and safer than having the straight ones are any day better in the public interest and in context of serving to the society in a better way. Even if the same is legal in the other states, if one state has come up with the decission to shape a better operation of trucks and trailerswithin the state lines, that can be much an impactful move for the other states for the future.
What is not a rule now, could be an example tomorrow. Thus Georgia state law is all justified in public interest and doesnt really violate the prevalent law . Georgia law is quite a whistle blower keeping in mind the safety aspect of the contoured mudguards
