Tom and Shane held guaranteed, confirmed reservations at the Double Tree Club for the night of November 14-15 with these rooms being held for late arrival with a major credit card. They arrived at the hotel at 2AM and found out that the hotel had no rooms left for them. The night clerk Mike, was deeply unapologetic and was not actively helping them two to find two hotel rooms. After all, Mike found them rooms at Shoney’s Inn & Suite, which is six miles further away from the downtown Houston, which makes a difference in morning rush-hour traffic. They also could only get smoking rooms. In addition to that, they left a note to Mike, asking him to give to their colleague Jon, who was planning to join them at the Double Tree Club in the morning. However, Mike did not give the note to Jon so he panicked.

Explanation / Answer

In the case the legal issue that arises is the fake promise or an assurance to give two rooms to them at the time of arrival at the hotels. the night clerk is also not performing his duty will , even he is not confirming that something other will be offered to them to compensate there losses. it is totally unethical.
