Case Scenario: Smith Family
Mrs. Melanie Smith has brought her daughter and son into your office. She reports that 3 months ago, the children’s father tried to set himself on fire after disclosing that he has abused both children. Mrs. Smith is highly distraught as she tells you the story. The children are 12 years old (daughter) and 7 years old (son). The children’s names are Dallas (daughter) and Zach (son). Mrs. Smith reports “no one in the family has been sleeping well” and “we don’t have appetites either.” The family has an open case with department of children’s services. Mrs. Smith is worried that she will be formerly charged with a failure to protect her children.
Explanation / Answer
Being a single parent is not easy and in such a case it becomes even more difficult to get the custody of the children and take care of them alone. Mrs Smith would have to undergo mental health evaluation herself and even drug testing to check whether she is physically and mentally fit to take care of her children. Also the court will check whether she finanicially stable to care of her children or not. Since parents have an obligation towards protecting their children there is higher risk that Mrs Smith could suffer charges for not being aware and able to protect her children. She could serve 18months in jail because of this negligence.
