You are the Human Resources manager for BigCo. The president of the company has informed you that today, you must eliminate one of the job positions in the accounting department. There are four people in the accounting department: Abe, who is a 63 years old Caucasian and has been with the company 35 years and walks with a cane and lives alone; Betty, who is a married 37 year old Hispanic, who has held this job for 6 months; Carol, a 26 year old Canadian, who has had this job for 8 years, and is gay; and Debbie, a 31 year old African-American single mother of 3 children, who has held this position for 12 years.

Choose an employee, and explain at least two (2) ethical &/or legal issues that would impact your decision to terminate this employee. Cite the relevant statute or law you are relying upon.

Explanation / Answer

As a HR Manager I would choose to terminate Betty who is a married 37 year old Hispanic Person. This decision of mine does not have any influence with respect to the race of the empoyee since according the Equal Employment Opportunity we are not supposed to discriminate anyone based on their colour, caste, religion or race.

The reason to eliminate Betty would just be due to her less experience with the company. For the accounting department experience is very important as they would be knowing the entire operations and the cash flow forecasts of the company. The knowledge that a person has acquired over the years due to their acquaintane with the company is very hard to replace. Hence the decisions will be based on the subject knowledge and the responsibilities of the individual.

If I decide to terminate any other employee then I would be forced to face the legal issues by stating that I have discriminated the employees from considering for equal employment and I would be liable to law. On ethical grounds it would be impossible to terminate a person who is a single mother or a old age person whose income seems to be crucial for their living.
